Understanding No Win No Fee Claims

Hiring an attorney is usually an expensive process often requiring a retainer of hundreds, or thousands, of dollars. Hard working individuals who have a legitimate case are often unable to file a law suit simply because they do not have the money to hire an attorney. One way for an average individual to hire an attorney and file a law suit is to find an attorney who offers no win no fee claims.

Conditional Fee Agreements, also referred to as no win no claims law suits, create a binding agreement between the attorney and a client. This agreement stipulates that the attorney will only collect a fee if they are able to win a claim on behalf of their client. When a claim is won, the attorney will take a percentage of the settlement as their compensation.

No win no fee claims are commonly offered by attorneys specializing in personal injury cases. Each attorney offering to take cases on a no win no fee claims basis has a different reason for doing so, but most individuals take these cases because insurance companies are quick to offer a settlement if they know they can be held responsible for the injury. Since the number of no win no fees claims has risen, some attorneys have even begun to charge the defendant directly for legal fees instead of taking a percentage of their client’s settlement.

No fee no win claims give individuals on a tight budget the chance to seek legal representation from top attorneys they might otherwise not been able to afford. When choosing a no fee no win claims attorney, remember to do your homework and to not agree to anything until you have shopped around. Unfortunately, there are many unscrupulous attorneys who will attempt to capitalize on your suffering by taking more of your settlement than is normal.
